青少年在青春期對異性產生好奇及憧憬屬正常現象,但往往因自我保護意識不足、對兩性關係欠缺正確認知,又或對法律規定存在誤解等,容易作出越界甚至犯罪行為,影響一生。根據本澳現行《刑法典》第166條“對兒童的性侵犯”、第168條“姦淫未成年人”,以及第169條“與未成年人的性慾行為”規定,與未滿14歲的未成年人性交或進行重要性慾行為,以及利用14歲至16歲的未成年人無經驗而作出上述行為,均屬嚴重罪行,即使對方同意及自願,行為人亦可被判處監禁;倘若雙方均屬未成年人,則適用第2/2007號法律“違法青少年教育監管制度”的相關規定,後果非常嚴重。
為向青少年傳遞潔身自愛、遠離犯罪的訊息,本局持續深入校園為不同年齡階段的學生舉辦防罪教育活動,包括以高等院校學生及中學生為對象的“預防性侵及求助方法”專題講座、面向小學及幼稚園學生的“防罪互動小百科──預防性侵及校園欺凌”主題互動教育遊戲,向同學們講解性犯罪的法律知識、預防和求助方法,冀提高他們的防罪警覺和自我保護能力。

It is normal for teenagers to be curious about sex and be attracted to the opposite sex during puberty. However, low self-protection awareness, lack of correct understanding of gender relations, or misinterpretation of the law may propel them to cross boundaries or even commit criminal acts with lifelong impact. Article 166 of the Macao Penal Code “Sexual abuse of children”, article 168 “Sexual intercourse with minors”, and article 169 “Sexual acts with minors”, engaging in sexual intercourse or significant sexual acts with minors under the age of 14, as well as exploiting the inexperience of minors aged 14 to 16 to commit such acts, constitutes serious crimes. Even if the minor consents, the perpetrator may still face imprisonment. If both parties are minors aged 12 to 15, the provisions of Law No. 2/2007 “Educational Supervision Regime for Young Offenders” apply, and the consequences are extremely serious.
The Judiciary Police continues to conduct crime-prevention education activities in schools for students of different age groups to promote self-respect and encourage them to stay away from crime. These include giving the lecture on “Prevention of sexual assault and methods of seeking help” for college and secondary school students, and playing the interactive educational game “Crime prevention mini encyclopedia – prevention of sexual assault and school bullying” with primary and kindergarten students. In these activities, we talk about the laws related to sexual crimes, teach students the methods to avoid being victimized, and how to seek help. We aim to enhance students’ awareness of crime prevention and self-protection skills.
